This Privacy Policy sets out how Sony Corporation, (of 7-1 Konan 1-chome, Minato-ku, Tokyo 108-0075, Japan) (“Sony”, “we”, “our” or “us”) collects, uses, stores and otherwise processes the Collected Data (defined as below) in relation to Sony’s “Imaging Edge” mobile, PC and web applications and/or services listed below (collectively, “Imaging Edge”). It also describes your data protection rights, including a right to object to some of the processing which Sony carries out. More information about your rights, and how to exercise them, is set out in Section 8 “Privacy Rights” below.

 

Sony Group Companies” shall mean Sony Group Corporation, which is the ultimate parent company of Sony and any legal entities controlled by Sony Group Corporation (the term “control” in this context means the direct or indirect ownership of at least fifty percent (50%) of the voting interest in such corporation or the power in fact to control the management decisions of such entity).

 

This Privacy Policy only applies to the Imaging Edge and is in addition to any other privacy policy that may apply to your interactions with any Sony Group Company or any third party, regarding their product, software or service.

1.      What personal information we collect

 

Sony collects data as described below which may include personal information (collectively, the “Collected Data”) related to your use of Imaging Edge.

 

Information collected through the Imaging Edge

 

When you use each of the following, Sony will collect the following information respectively:

 

·           Imaging Edge Mobile / Imaging Edge Mobile Plus (“IEM”)

1.         Your Universally Unique Identifier (“UUID”) of IEM

2.         Your UUID generated and given by Adobe

3.         Information about IEM (e.g., software version, installation date, language and country/region settings)

4.         Information about your mobile device (e.g., model name, manufacturer’s name, OS version, and language)

5.         Information about your camera device connected to IEM (e.g., model name, settings, errors/cautions, operation log including shooting dates/times, mount lens and mount media)

6.         Information you provide in response to questionnaires, such as your level of skill as a photographer and the subjects you like to photograph

·           Transfer & Tagging / Transfer & Tagging add-on (“TTAD”)

1.         Your UUID of TTAD

2.         Information about TTAD (e.g., software version, installation date, language and country/region settings)

3.         Information about your mobile device (e.g., model name, manufacturer’s name, OS version, and language)

4.         Information about photographed images of your camera device transferred to TTAD (e.g., file name, file size and caption data)

5.         IPTC preset and user dictionary added or imported by you

4.         Information about photographed images you upload to VS, including images transferred from your camera to your mobile device via VS (faces, objects, scenes, etc.) and metadata information such as Exif and XMP, metadata information of the images (shooting date, orientation, focus position information, retouch parameter, etc.), information regarding gallery (layout, font, event name, event date, password added on gallery, etc.), information regarding photographer that you add to gallery (nickname, email address, URL, hashtags etc. ), tag/label information added to the pictures by detection functions of VS and IPTC metadata

5.         Information you provide in response to questionnaires (such as, your level of skill as a photographer and the types of subjects you photograph)

6.         Transaction information related to purchase of a VS service plan (VS service plan purchased, payment history, etc.)

 

Please note that Sony will not use either photographer information added to gallery or face information processed by the scene detection and/or face detection functions of Visual Story for any purposes other than performing its contract with you to provide Imaging Edge.

 

Please note that Sony also automatically receives device and usage information about how you are using and interacting with Imaging Edge, for example: information about which of the Imaging Edge functions you choose to use, picture transfer times and movie recording time.

 

If you install and use more than one Imaging Edge feature or service on the same device, Collected Data collected through either one will be linked to and analyzed in conjunction with Collected Data collected through the other by using your UUIDs only for the purposes set forth below. Also, if you use Imaging Edge with PlayMemories Home on the same PC, Collected Data collected through the Imaging Edge will be linked to and analyzed in conjunction with Collected Data collected through PlayMemories Home by using your UUIDs solely for the purposes set forth below. Sony may also supplement Collected Data with other data collected about you from third parties. 

 

If you have a Creators’ Cloud Account, your registered account information (Name, Email address, Date of birth, Address (Country/Region and City) and/or Language preferences) will be linked to and analyzed in conjunction with Collected Data only for the purposes set forth below. 2.      Purposes and legal basis for processing Collected Data

 

Sony processes Collected Data in order to perform its contract with you to provide Imaging Edge.

 

Improving, designing and developing products and services

If you give us your consent, Sony will collect and/or analyze Collected Data in order to improve Sony Group Companies’ products and services and to develop new ones, and to predict the demand for those products and services so that we can provide improved user experiences for current and/or future products and services. You can withdraw your consent and stop our use of the Collected Data for Improving, designing and developing and products and services at any time by MenuPrivacy settings.

 

Marketing tailored for you

If you give us your consent, Sony will use the Collected Data in order to provide you with information, recommendations and marketing regarding our products and services which is tailored for you through Imaging Edge notifications. In addition, if you give your consent, Sony will share the Collected Data with its local Sony office to provide you with information, recommendations, targeted and/or personalized marketing and emails regarding Sony products, services and other offerings that may be of interest to you. You can unsubscribe from receiving email marketing from your local Sony office at any time using the “unsubscribe” link in such email or contacting us as described in Section 10 below.

 

Your local Sony company may share Collected Data with, network advertisers or others in order to target advertisements to you or limit the number of times you see advertisements. Please be aware that if you choose to block cookies, some advertising preferences dependent on cookies may not be able to be respected and that even if you opt out of targeted online advertising, you will continue to receive generic ads online.

 

Sony also processes Collected Data in order to pursue its legitimate interests in:

 

1.       Protecting Sony Group Companies and the Imaging Edge users

Sony may collect and/or analyze Collected Data in order to identify potential security threats and to protect Sony, Sony Group Companies and the Imaging Edge users.

 

2.       Providing certain information and service related to your Sony digital camera product

If you use Sony digital camera product with Imaging Edge, Sony will use Collected Data in order to provide you with information regarding your Sony digital camera product and for support services, including repair of your digital camera product and response to your inquiry.

 

3.       As required by law

We also process Collected Data where required to do so by applicable law, for example in response to requests by government or law enforcement authorities conducting an investigation.

 

3.      Who else has access to Collected Data?

 

Collected Data that is communicated to and stored by Sony will be made available to other Sony Group Companies and to third party as follows:

 

Sony Group Companies and third party contractors

We will share Collected Data with Sony Group Companies, which locally sell and provide our products and services, solely for the purposes set forth above. In addition, we will share Collected Data with Amazon Web Services who provides data back-up service to us, and which is located in the US. This contractor is engaged for the purposes of pursuing the activities outlined in this Privacy Policy on Sony’s behalf, acting as processors of Sony.

 

Google Services

The Imaging Edge uses Firebase Crashlytics, a service provided by Google Inc. (“Google”) and the TTAD also uses Google Speech-to-text API, an API provided by Google. Firebase Crashlytics will track, prioritize and fix stability issues that erode quality of the Imaging Edge you use, and Google Speech-to-text API will be used for voice-input function of the TTAD. VS uses Google ML Kit, an API provided by Google. Google ML Kit will be used for face detection function and only its performance data and frequency of use will be provided to Google. Adobe Analytics

The IEM uses Adobe Analytics, a service provided by Adobe Systems Incorporated ("Adobe"). Adobe Analytics will analyze how you use the IEM after turning your IP address into non-recognizable strings. App distribution platforms

We may provide the App distribution platform, their subsidiaries and agents with information about use of Imaging Edge to provide transaction services and for purposes of process improvement.

 

Business transfer

In the event that we sell or transfer a portion or all of our business, Collected Data may be transferred by us to the purchasing or acquiring entity as part of the transaction. In the event we sell or transfer Collected Data to a purchasing or acquiring entity you will be duly informed.

 

Compliance and enforcement

We will retain, use and/or disclose any of Collected Data as required or permitted by law, regulation or order, including to the police or other appropriate authorities, to investigate complaints made by or against you, or to protect or defend ourselves, or others, against illegal, criminal or harmful activities.

 

4.      Data Retention, Managing Collected Data

 

We will continue to retain Collected Data for as long as we continue to make Imaging Edge available to customers, and for a further 6 months following discontinuation, at which point the information will either be anonymized or destroyed. Please note that we may be required to retain certain information by law.

 

5.      International Transfer of Collected Data

 

Collected Data will be processed, stored and transferred for the purposes outlined in this Privacy Policy to various countries outside your country of residence, including Japan and the US. Collected Data will be processed by staff operating outside your country of residence who work for us or for one of our service providers and may be seen by such staff in those countries.

Sony takes appropriate measures to ensure that all transfers of Collected Data from your country to countries outside your country meet the requirements of applicable law.

 

6.      Security

 

Sony undertakes reasonable security measures designed to protect against the loss, misuse or alteration of Collected Data. Although we strive to protect Collected Data, we cannot guarantee or warrant the security of any information transmitted to us through your Imaging Edge or that we store on our systems or that is stored on our third party contractors’ systems.

 

7.      Our Policy Regarding Children

 

Sony is committed to complying with all applicable laws and regulations regarding the collection, storage and use of personal information concerning children, including the Children's Online Privacy Protection Act in the United States and applicable local legislation in other countries. Imaging Edge is directed to a general audience and is not targeted for users younger than the age of 16. If you are a parent or guardian and are concerned that your child has provided us with personal information without your consent, you should contact us as indicated in Section 10 below.

 

8.      Privacy Rights

 

In some countries or jurisdictions, you may have certain rights with respect to the Collected Data Sony processes about you. These may include the right to request access to the Collected Data that Sony holds about you and/or you may request that Sony, correct, delete, destroy or block/restrict processing of such Collected Data. In some countries or jurisdictions, you may also ask us to provide your Collected Data to you in a structured, machine-readable format and ask us to share (port) such data with another organization. The following are some examples of reasons these rights may be limited: fulfilling your request would reveal Collected Data about another person, you ask us to delete or destroy information which we are required by law to keep or you ask us to delete or destroy information we have compelling legitimate interests in keeping. If you would like to exercise any rights available to you, please refer to the section regarding “Jurisdiction Specific Rights” or contact us as described in Section 10 below.

This Privacy Policy may be updated from time to time for any reason. We will notify you or request your consent (if necessary under applicable law) of any changes to this Privacy Policy.

         Right to Opt-out of Targeted Advertising and/or Sales of Personal Data: You may also have the right to opt-out of “sales” of personal data and the processing of Personal Data for the purposes of targeted advertising. Sony engages in online advertising and analytics practices that may be considered targeted advertising and/or “sales” of personal data. To exercise your rights to opt-out of targeted advertising and/or sales of personal data, please ensure the privacy policy setting of the Imaging Edge to share data with your local Sony electronics company is disabled. In addition, you may need to disable sharing through cookies set by 3rd parties on certain Sony websites which may be considered targeted advertising. Right to Opt-Out of Automated Decision Making and Profiling: While state laws may permit you to opt-out of automated decision making and/or profiling in furtherance of decisions that produce legal or similarly significant effects, we do not engage in this activity at this time.

 

Notice to Nevada Residents:

If you are a Nevada resident, you have the right to opt-out of the sale of certain personally identifiable information we have collected about you to third parties. Sony does not currently sell your personally identifiable information as those terms are defined under Nevada law. However, if you wish to submit a request to opt-out of the sale of such information in case that Sony were to engage in such a sale in the future, you may submit your request in writing to: privacy@am.sony.com. Your request must reference your Nevada rights and include your name, mailing address, zip code, and email address. Your request is subject to verification of your identity by us and validation of your request. We are not responsible for requests that do not come through the designated request mechanism or do not contain sufficient information to allow us to process your request. Notice to California Residents: California Privacy Notice

This California Privacy Notice is effective as of July 19, 2024.

 

This California Privacy Notice supplements our Privacy Policy sets forth the disclosures and rights for California Consumers regarding their personal information, as required by the California Consumer Privacy Act, as amended, and any implementing regulations adopted thereunder (“CPRA”). Terms (including defined capitalized terms) used in this California Privacy Notice have the same meanings given in the CPRA, unless otherwise defined.

 

California Consumer Rights. Subject to certain exceptions, as a California consumer, you may have the following rights regarding your CA Personal Information:

Our use of any Sensitive Personal Information falls within an exception, so we do not offer this right at this time.

 

Agents. If you are an authorized representative submitting a request on a consumer’s behalf, please complete the applicable request per the instructions below. We will follow up to request a signed, written permission signed by the individual who is the subject of the request authorizing you to make the request on their behalf. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request, and a clear description of the permission granted. Alternatively, you may submit a copy of a power of attorney under applicable state law. In either case, please also indicate in your email the nature of your request. The consumer’s identity, in addition to your own, will need to be independently verified in order for us to be able to fulfill your request. We may also ask the consumer to directly confirm with us that they provided you permission to submit the request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer’s behalf, we may deny the request.

 

Verifying Requests. In your request, you must provide enough information to allow us to verify you are the person about whom we collected Personal Information, or their authorized representative. You must also describe your request with enough detail so that we can understand, evaluate and respond to it. We will only use the information you provide in a request to verify your identity.

 

When you exercise your Right to Know, Right to Delete, and/or Right to Correct, we may ask that you provide us with additional information in order to verify your identity and fulfill your request. If we are unable to verify your identity, we will not be able to process the request.

Data Retention

We retain all categories of Personal Information described in this California Privacy Notice for as long as it is reasonably necessary for the purposes outlined in this California Privacy Notice, considering the time period reasonably necessary to: provide the goods or services you request; exercise the choices and rights you have requested; comply with our contractual obligations;  comply with applicable legal, regulatory, or other obligations; including litigation holds and agency regulations. Except as noted differently specific pages or apps, we retain your personal information while you have an account with us, or while you are using Imaging Edge or continuing to interact with us.

Notice to Quebec (Canada) Residents: This notice sets forth disclosures and rights for consumers residing in Québec regarding their personal information, as required by the Québec’s Data Privacy Law 25.

 

Profiling: With your consent, we may use technologies which collect information about your use of the application associated with your Account that may enable us to develop a profile of your interests or preferences.

 

Location Tracking: We may use technologies which collect information about your general location, such as the country in which you are located; however, we do not track your location without your consent.

 

Consumer Rights:

Subject to certain exceptions, you may have the following rights regarding your personal information:

§  Right to Access and Request Information On Data Processing. Request information about our data processing activities, namely what personal information was collected from you and how we process it. You may ask us to clarify the categories of persons that have access to your personal information and the applicable retention period for that information.

§  Right to Rectify. Request rectification of inaccurate personal information we maintain about you.

§  Rights Regarding the Use of Automated Decision-making. You have the right to request that we tell you if we use your personal information to render a decision based exclusively on automated processing of such information and additional information about such processing. However, Sony does not use personal information to render any decisions based exclusively on an automated processing of such information.

§  Right to Withdraw Consent. Request to withdraw your consent to our collection, use, and disclosure of personal information at any time. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
